TERMS AND CONDITIONS OF SALE

FOREWORD

These general conditions have as their object the purchase of products, made at a distance by means of telematic network through the site www.ferramentabriatore.com owned by Ferramenta Briatore di Leonti Ugo with headquarters Corso dello Statuto 22 – 12084 Mondovì – CN – Italy. Purchase transactions will be governed by the provisions of Legislative Decree no. 185 of 22.5.1999, while the protection of confidentiality will be subject to the discipline of Legislative Decree 196/03

1. ACCEPTANCE OF CONDITIONS OF SALE

1.1 The conditions stipulated in the foreword are an integral and essential part of this contract.
1.2 All contracts will be concluded directly through access by the Customer (Business and Individuals) to the website corresponding to the address www.ferramentabriatore.com. Then the Customer can conclude the contract for the purchase of the desired product by carefully following the directions and procedures provided.
1.3 These general conditions of sale must be reviewed “on line” by the Customer, prior to the completion of the purchase procedure. The submission of the order confirmation therefore implies full knowledge of them and their full acceptance.
1.4 Ferramenta Briatore di Leonti Ugo reserves the right to refuse orders from customers with whom there is an ongoing dispute regarding payment for a previous order.

2. SALE PRICES AND PURCHASE METHODS

2.1 All sales prices of the products displayed and indicated within the website www.ferramentabriatore.com are inclusive of V.A.T. and any other taxes. Prices, where not specified, are for a single product.
2.2 Product prices may be subject to updates. The customer is required to ascertain the final sale price before placing the relevant order. The blatant material error reported in the price present on the Site with respect to the commonly known price of the chosen product, entails the right for Ferramenta Briatore di Leonti Ugo not to confirm the shipment and proceed with an immediate refund of the value of the purchase paid by the customer without the latter being able to oppose any exceptions in this regard
2.3 The total cost of shipping up to the Customer’s domicile shall be borne by the Customer. This cost will in any case be made known to the Customer before confirmation of the purchase.
2.4 The purchase contract is finalized by the exact completion and consent to purchase manifested through the membership given “online” after registering.
2.5 The Customer may pay for the ordered goods using the payment methods indicated “online” at the time of purchase.
2.6 To conclude their purchase contract with Ferramenta Briatore di Leonti Ugo, the customer must transmit their order to it by following the procedure recalled on the Site. Sending the order electronically triggers the customer’s obligation to pay the total price specified therein

3. LIABILITY AND WARRANTIES

3.1 Ferramenta Briatore di Leonti Ugo assumes no responsibility for inefficiencies attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that would prevent, in whole or in part, the execution of the contract within the agreed time frame.
3.2 Ferramenta Briatore di Leonti Ugo is not responsible for any fraudulent and illicit use that may be made by third parties, of credit cards, checks and other means of payment, when paying for products purchased. P Ferramenta Briatore di Leonti Ugo, in fact, at no time during the purchase process is able to know the buyer’s credit card number, which, via a secure connection, is transmitted directly to the bank service provider.
3.3 It is guaranteed that the present images depict, in every detail, the work for sale. Images of each individual product are provided by the manufacturer who may change more or less important details at any time at THEIR discretion. Ferramenta Briatore di Leonti Ugo therefore is not held responsible for any discrepancies between what is received by the customer and what is stated in the product images. (A mere example label color, jar caps, box color and shape etc etc).
3.4 For all civil and panal disputes, the sole place of jurisdiction is at the headquarters of Ferramenta Briatore di Leonti Ugo – Court of Cuneo.

4. WITHDRAWAL

4.1 The consumer has the right to withdraw from the purchase, without penalty, within the period of 10 days, starting from the day of receipt of the goods.The material must be returned undamaged and in its original packaging within the period of 10 days.
4.2 Shipping costs and shipping responsibility are the responsibility of the customer (shipment must be insured and accompanied by any customs declaration).
4.3 If the customer intends to make use of the right of withdrawal, he/she must give notice as soon as possible (no later than 10 days) by email or postal letter with return receipt, before shipping the package.
4.4 The refund of the purchase price of the item, does not consider the shipping and packaging costs incurred to get it.

5. OBLIGATIONS OF THE CUSTOMER

5.1 The data entered during purchase must be only your own real personal data and not the data of a third person, or fantasy data. Ferramenta Briatore di Leonti Ugo reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers.
5.2 The customer indemnifies Ferramenta Briatore di Leonti Ugo from any liability arising from the issuance of erroneous tax documents due to errors related to the data provided by the customer, as he/she is solely responsible for their correct entry.

REFUND INFORMATION

Pursuant to Legislative Decree no. 206/05, the customer in case of purchase of products on the site of Ferramenta Briatore di Leonti Ugo has the right to withdraw from the contract within 10 working days from the date of delivery of the goods and without having to provide any reason. The withdrawal period expires after 10 business days from the day the customer or a third party-other than the carrier and designated by the customer-gains physical possession of the goods. To exercise the right of withdrawal, the client is required to inform Enoteca Il Vinoso of the decision to withdraw by an explicit statement sent to the contacts indicated.
This communication should be sent by e-mail to ferramentabriatore@gmail.com. The purchased goods must be intact and returned in the original packaging, complete in all its parts; if the original shipping packaging is damaged, we recommend replacing it or placing it in another box. The return shipment, up to the certificate of receipt in Ferramenta Briatore’s warehouse, is the full responsibility of the consumer.

Ferramenta Briatore di Leonti Ugo is not liable in any way for damage or theft/loss of goods returned by uninsured shipments. Return costs are the responsibility of the customer. Without prejudice to any charges for products returned partially damaged, Ferramenta Briatore di Leonti Ugo will refund the consumer, as soon as possible and in any case no later than 10 days after the return of the goods, through the transfer procedure of the amount charged on the Credit Card, subject to the affixing of the appropriate wording ” Reserve control” or “Damaged Package(s)” on the delivery note of the courier.
The right of withdrawal lapses totally, for lack of the essential condition of integrity of the good (packaging and / or its contents), in cases where Ferramenta Briatore di Leonti Ugo ascertains:
Even partial use of the asset and any ancillary materials;
The lack of the original outer packaging and/or inner packaging;
The absence of integral elements of the product (any accessories built into the product);
Damage to the product due to causes other than its transportation.

In the above cases, Ferramenta Briatore di Leonti Ugo will return the purchased goods to the consumer, charging him/her for the cost of further shipment.

The right of withdrawal under Art. 59 of the Consumer Code does not apply to goods that are custom-made or clearly personalized or that, by their nature, are likely to deteriorate rapidly, are sealed and not suitable for return for hygienic reasons or are related to health protection and have been opened after delivery.
